Trademark Registration for Selling on Ozon and Wildberries

You can sell on a Russian marketplace without a trademark. But protecting your brand from copycats, reporting counterfeits and, from March 1, 2027, confirming your rights directly in the product listing all require a trademark registered in Russia. Here is what the new rules say and how to get ready in time.

In short

Russian law does not require a trademark to sell on Ozon or Wildberries. But under Russian Government Decree No. 821 of July 2, 2026, from March 1, 2027, a seller can add the registration number of its trademark, or of a registered license, to a product listing. The marketplace checks it against the State Trademark Register and shows the registered mark in the listing. Under the wording of the rules, this takes a mark registered by Rospatent, Russia's Federal Service for Intellectual Property, in the State Register: an application, a Chinese registration or a Madrid registration is not enough. Registration usually takes 8–12 months, so the time to file is now.

1. Do you need a trademark to sell on a marketplace?

You can open a store on Ozon or Wildberries without a trademark of your own: the law sets no such condition. You can also put a brand name in a listing without registering it. But that name does not belong to you. Another seller, or even your own distributor, can register it, and then you are the one who has to prove your rights.

A trademark registered in Russia gives a seller what a brand on a marketplace cannot do without:

  • Rights confirmed in the listing. From March 1, 2027, this works through the registration number in the State Trademark Register (details below).
  • Complaints about counterfeits and copied listings. The marketplace acts on a claim from the trademark owner, and the claim rests on a mark protected in Russia.
  • Brand owner programs. Wildberries and Ozon run their own tools, such as brand representative status and the “Original” badge. The marketplaces set the terms, and they rely on rights backed by documents.
  • The right to demand that infringement stop and to claim compensation (Russian Civil Code, Arts. 1252 and 1515), including from sellers outside the marketplace.

2. What changes on March 1, 2027

Russia's federal law on the platform economy (Federal Law No. 289-FZ of July 31, 2025) has been in force since October 1, 2026. Russian Government Decree No. 821 of July 2, 2026, sets out how marketplaces check product listings. They compare listing data with 12 state registers, one of which is the State Register of Trademarks and Service Marks of the Russian Federation.

Section IX of the rules covers trademarks and takes effect on March 1, 2027. From that date a seller can state in a listing:

  • that it owns the mark, together with the registration number and the date the mark was entered in the State Trademark Register;
  • that it holds a right to use the mark under an agreement, together with the number and date of the state registration of that agreement.

If the details match, the marketplace places in the listing an image of the mark taken from the State Trademark Register (para. 41 of the rules). That sets a listing with a verified mark apart from one where the seller simply typed in a brand name.

What will not pass the check

A pending application is not enough: the listing needs the registration number and the date of entry in the State Trademark Register, and a mark gets them only once it is registered. A registration in China does not count: the check runs against the Russian register. A Madrid registration designating Russia is recorded in the WIPO International Register, while the rules expressly refer to marks registered by Rospatent in the State Register. If the brand matters for marketplace sales, a national application to Rospatent is the safer route.

3. How the marketplace checks your rights

Under paras. 39 and 40 of the rules, the check has two parts, and both must match:

  1. Number and date. The registration number of the mark or agreement and the date of entry given in the listing match the State Trademark Register.
  2. Seller. The seller details the marketplace verified at onboarding match the register entry: the company's name, registered office and address including the country, or the full name of an individual.

The second condition matters more than it seems. If the mark is registered to one company and another company sells on the marketplace, the check fails. It also fails when the company has changed its name or address but the register still shows the old details. That is why I enter the applicant's name and address exactly as they appear in the company documents and the seller account, and correct outdated details through an amendment of the register.

If the seller changes or removes these details in the listing, the marketplace takes the image of the mark down within 3 hours and checks the new details within 3 business days (paras. 42 and 43 of the rules).

4. Which Nice classes to register

A trademark is protected only for the goods listed in its registration. So the list should cover what you sell on the marketplace and plan to sell in the next few years. Classes for common marketplace categories:

What you sellNice class
Cosmetics, perfume, personal care3
Smartphones, earphones, chargers, phone cases9
Lamps, electric kettles, heaters11
Bags, backpacks, wallets18
Furniture20
Tableware and kitchen utensils21
Clothing, footwear, headwear25
Toys, sporting goods28

The exact class depends on how the goods are worded, so I draw up the list from your product range. Since October 4, 2025, each item over 10 in one class adds CNY 40 to the examination fee and the same again at renewal, so listing hundreds of items “just in case” does not pay. For your own products, the classes of the goods themselves are what matters; class 35 (retail services) is needed if you sell other companies' goods under the mark as a store.

5. When a distributor or partner sells on the marketplace

Often the mark belongs to a Chinese manufacturer, while a Russian distributor, importer or separate seller trades on Ozon and Wildberries. In that case the listing shows not the trademark registration but the state registration of the agreement granting the seller the right to use the mark (paras. 38 and 40 of the rules). A letter of authorization or an unregistered agreement will not pass this check, because the register has no record of it. Without registration, the grant of the right is treated as not having taken place at all (Russian Civil Code, Art. 1232(6)).

I draft the license agreement around your sales model, covering the territory, term, goods and quality requirements, and register it at Rospatent: CNY 1,500 for the work plus a CNY 1,200 official fee. More on the license agreement page.

Has someone else already registered your brand?

This happens when a distributor files your brand in its own name. If it agrees to hand the mark back, we sign an assignment agreement and register the transfer. If not, I assess the grounds for challenging the registration. Either way, we start by checking the State Trademark Register.

6. Cost and timing

Registration usually takes 8–12 months from filing, but the priority date is fixed on the day you file. An application filed today takes precedence over anyone who later files a similar mark for the same goods (Russian Civil Code, Art. 1494).

Questions about trademarks for marketplaces

Can I sell on Ozon and Wildberries without a trademark?

Yes, the law does not require a trademark to sell on a marketplace. But without a registration in Russia the brand name is not yours: you cannot protect it from copies, confirm your rights in the listing or report counterfeits.

Will a pending application pass the listing check?

No. The listing needs the trademark registration number and the date of entry in the State Trademark Register (para. 38 of the rules approved by Decree No. 821), and these exist only after registration. That is why it pays to file early.

Does a trademark registered in China count?

No. Trademark protection is territorial, and the marketplace checks the listing against the Russian State Trademark Register. The mark has to be registered at Rospatent.

Our store is registered to a Russian company, but the mark belongs to our Chinese company. What should we do?

The Russian company needs a license agreement registered at Rospatent. It enters the registration number and date in the listing, and the marketplace checks them against the register.

Do I need to register the name in Cyrillic?

If the brand appears in Russian letters in the listing and on the packaging, it is safer to register the Cyrillic version as well. Latin and Cyrillic spellings are different marks, and otherwise you would have to prove that the transliteration is similar.

How much does a trademark for a marketplace cost?

Full service: CNY 3,200 for the work plus official fees from CNY 2,750 for one class, from CNY 5,950 in total. A clearance search before filing starts at CNY 550. Payment in yuan by international transfer; the contract is in Russian or English.
