Questions about filing
What is the priority date and why secure it?
It is the date of filing (Russian Civil Code, Art. 1494). If someone later applies for a similar mark for similar goods, your application takes precedence. That is why it is best to file before entering the Russian market.
What happens if the examiner sends a notice?
I forward it with an explanation and offer to prepare a reply, from CNY 1,000. Time limits depend on the document: for a notice after substantive examination, arguments are considered if filed within 6 months (Art. 1499(3)). Without a reply the application may be refused or deemed withdrawn.
Can I keep the priority date of my Chinese application?
Yes, if no more than 6 months have passed since your first filing in China: you claim Paris Convention priority (Art. 1495). The claim must be made at filing or within 2 months afterwards, and a copy of the first application supplied within 3 months of the filing date. If you already have a Chinese application, you can also designate Russia under the Madrid system: the options are compared in the guide.
In which currency do I pay?
Payment is accepted in Chinese yuan (CNY) by international transfer against an invoice. I pay Rospatent's fees on your behalf, so you do not need a Russian account.
